“While the matter is of an important nature, everything cannot come before the Supreme Court. Therefore, the petitioner should approach the concerned High Court.” the Bench of Justices Deepak Gupta and Surya Kant said dismissing the petition.

The petition was filed by Advocate Ashwini Kumar Upadhyay. The bench said that a similar matter is pending before the Madras High Court and should be approached for the same. Upadhyay later requested Court to give liberty to him to withdraw the PIL.

To this, the Court agreed and now he has the liberty to move to the High Court he wishes to pursue the issue.
